Building in Brazil: the stages every company needs to know

A commercial or industrial project in Brazil follows a defined path, with approvals that depend on one another. Companies arriving from abroad tend to underestimate how long these stages take, because the sequence differs from the one they know at home. Understanding this path before signing any contract prevents most delays.

1. Feasibility and zoning

Before design begins, you check what municipal law allows on that particular plot: permitted use, maximum built area, setbacks, height and required parking. In Sao Paulo these parameters come from the Master Plan and the Zoning Law, and they change from street to street.

This is the cheapest stage to correct and the most expensive to skip. A plot that cannot accommodate the intended operation only reveals that problem here, or, in the worst case, after the purchase.

2. Planning permission design and construction design

These are two distinct documents with distinct purposes. The planning permission design is what goes to the city hall for approval and demonstrates that the building complies with urban planning rules. The construction design is what the site actually builds from, detailing structure, building services, materials and finishes.

Hiring construction with only the planning permission design in hand is the most common source of contract variations. Without the construction design, many technical decisions have not been made yet, and each one becomes a price negotiation with the work already under way.

3. Approvals and permits

Depending on size and activity, the project goes through approval at the city hall, the fire department and, in certain cases, environmental and traffic authorities. Each has its own requirements and timelines, and several processes run in parallel.

To operate commercially, two documents are usually decisive. The Habite-se certifies that construction followed the approved design. The AVCB is the fire department inspection certificate. Without these two documents the building is finished but cannot open its doors.

4. Construction and management

During construction, what determines the outcome is management: a physical and financial schedule tracked week by week, quality control at the stages that end up concealed, measurements that match what was actually built, and a documented record of every decision.

Projects carried out while the property stays in operation require additional planning, with phased execution, isolation between the work area and the occupied area, and negotiated windows for the most disruptive services.

5. Handover and final documentation

Handover does not end with the last coat of paint. It involves testing the building systems, operation and maintenance manuals, as-built drawings and the warranty for each item. For a foreign company, this documentation is what allows it to operate the building, insure it and, later, sell or renovate it without having to rediscover everything from scratch.

What surprises newcomers most

  • The sequence of approvals: some processes can only begin after others are finished, which makes the total timeline longer than the sum of its stages.
  • The weight of documentation: technical responsibility records, registrations and certificates accompany every phase and are required during inspections.
  • The difference between quoting and contracting: proposals with different scopes cannot be compared by final price, and the cheapest one is usually the one that left items out.
  • The importance of the contract: deadlines, measurement criteria, price adjustment and how variations are handled, all defined up front, prevent most later disputes.
